Pool owners are being reminded to check barriers and gates before anyone dives in or risk facing a fine.

With summer in full swing, Tauranga City Council warns anyone with a permanent or portable pool has to adhere to local fencing rules.

Compliance team leader Denise Hyde said pool owners have a responsibility to ensure all barriers on their property were safe.

“As the weather warms up, many people set up portable pools without realising there’s a legal requirement to fence them.”

Under the Building Act, any pool or spa capable of holding water to a depth of 400mm or more must have a fence, even if it is only partially filled.

“If the side walls are 1200mm high and can’t be climbed, a barrier might not be needed. But if there’s a portable ladder, it needs to have an enclosing barrier and gate around it,” Hyde said.

For pools installed after January 1, 2017, removable ladders were not allowed unless they’re enclosed by a fully compliant barrier and pool gate.

Failure to have the right barriers in place could result in fines.

There were no water restrictions in place in Tauranga this summer, but the council encouraged the community to make wise choices about using water.
